Ask three websites what stamp duty a rent agreement needs in Gujarat and you will get three answers. Most of them were written before the Gujarat Stamp (Amendment) Act, 2025, published in the Gujarat Government Gazette on 2 April 2025. That amendment replaced the lease rates in Article 30 of Schedule I to the Gujarat Stamp Act, 1958, and deleted Article 30A, the old leave-and-licence entry that many calculators still use.
The rates now, for a lease at a fixed rent
Article 30(a) covers the common case: a fixed monthly rent, no premium or non-refundable advance. The duty depends on how long the agreement runs:
- Less than 1 year: a flat ₹500 for residential property, ₹1,000 for commercial.
- 1 to 5 years: ₹1 for every ₹100 (or part of ₹100) of the average annual rent. Minimum ₹1,000 for residential, ₹5,000 for commercial.
- 5 to 15 years: ₹2 per ₹100 of the average annual rent, minimum ₹10,000.
- 15 to 30 years: ₹3 per ₹100 of the average annual rent, minimum ₹20,000.
- 30 to 99 years: 2.5% of the consideration or the market value, whichever is higher. Above 99 years: the same duty as a sale (conveyance).

Worked examples
- 11-month agreement for a flat in Surat at ₹15,000 a month: under one year, residential, so ₹500. The rent does not matter.
- 2-year agreement for a flat at ₹20,000 a month: average annual rent ₹2,40,000. 1% is ₹2,400, above the ₹1,000 minimum, so ₹2,400.
- 3-year agreement with a 10% yearly increase (₹20,000, then ₹22,000, then ₹24,200 a month): total rent ₹7,94,400, average annual rent ₹2,64,800, duty ₹2,648.
- 2-year agreement for a shop at ₹30,000 a month: 1% of ₹3,60,000 is ₹3,600, but the commercial minimum is ₹5,000, so ₹5,000.
Why most rent agreements are 11 months
Two reasons, and both are about the one-year line. Under one year, Gujarat's duty is a flat ₹500 instead of a percentage. And under the Registration Act, 1908, a lease for a term of more than one year must be registered, which means a visit to the sub-registrar, a registration fee and both parties' presence or e-registration. An 11-month agreement avoids both. It also means renewing, and paying the ₹500 again, every 11 months.
Three things that change the answer
- A premium or non-refundable advance. Article 30(a) is for a fixed rent with no premium. If the landlord takes a lump sum that is not a refundable deposit, other clauses of Article 30 apply. Read the agreement before you buy the stamp paper.
- Commercial leave-and-licence agreements. The 2025 amendment deleted Article 30A, which dealt with non-residential leave and licence, without a direct replacement. If you are renting an office or shop on a leave-and-licence document, have a lawyer confirm the duty.
- Escalation clauses. The duty is on the average annual rent across the whole term, so a yearly increase raises it. Add up every month's rent, divide by the number of years, then apply the rate.
How to pay it
Stamp duty in Gujarat is usually paid through an e-stamp certificate (available from authorised e-stamping centres and banks) or a franking machine, rather than old-style printed stamp paper. Buy it in the name of either party, for the exact duty, before or on the day you sign. Underpaying is not a small detail: an agreement that is not properly stamped can be refused as evidence until the deficit and a penalty are paid, which matters exactly when there is a dispute over the deposit.
Renting or buying?
If you are signing your third 11-month agreement in a row, it is worth running the rent-versus-buy numbers once. Rent is not 'wasted money', but neither is a home loan automatically better; it depends on the price-to-rent ratio in your area and how long you will stay.

- What is the stamp duty on an 11-month rent agreement in Gujarat?
- For residential property, a flat ₹500 under Article 30(a) of the Gujarat Stamp Act, as amended in 2025, because the term is less than one year. For commercial property it is ₹1,000.
- How is stamp duty calculated for a 2 or 3-year rent agreement in Gujarat?
- ₹1 for every ₹100 of the average annual rent, with a minimum of ₹1,000 for residential and ₹5,000 for commercial property. Add all the rent for the term, divide by the number of years, and take 1%.
- Is the security deposit included in the stamp duty?
- Article 30(a) is charged on the average annual rent for a lease with a fixed rent and no premium. A lump sum that is a premium or non-refundable advance falls under other clauses of Article 30, so check how the agreement describes the deposit.
- Does a rent agreement in Gujarat need registration?
- Under the Registration Act, 1908, a lease for a term of more than one year must be registered. That is one reason most agreements are drawn for 11 months.
- Is Article 30A still applicable in Gujarat?
- No. The Gujarat Stamp (Amendment) Act, 2025 deleted Article 30A, the entry for leave and licence of non-residential property. Calculators that still use it are out of date.
