If it still isn't paid, in order

  1. Email HR and payroll (above) and keep the reply. Ask for the itemised F&F statement in writing.
  2. Send a written reminder after a week, quoting Section 17(2) of the Code on Wages and the date it was due.
  3. File a claim with your state labour department's claims authority under Section 45 of the Code on Wages — within three years. It can award the amount plus compensation of up to ten times.
  4. Unpaid gratuity goes to the Controlling Authority (the labour department) for your area.

Most F&F calculators online are built for HR teams working out what to pay. This one is for the person who left: it shows what you should receive, line by line, and when it is legally due.

The rule changed on 21 November 2025. The Code on Wages now gives a company two working days to pay the wages of someone who has resigned, where waiting 30 to 45 days used to be normal. Enter your last working day, salary, unused leave and service, and the checker shows the amount, the deadline, how late it is, and an email to HR in English or Hindi.

Code on Wages, 2019, s.17(2) (wages within two working days; in force 21 November 2025) and s.45 (claims, up to ten times compensation); Code on Social Security, 2020 (gratuity, including pro-rata for fixed-term employees); Income-tax Act s.10(10AA)(ii) and CBDT Notification 31/2023 (leave encashment exemption ₹25 lakh); s.10(10) (gratuity exemption ₹20 lakh).

Company policy decides the salary and leave divisors, how much leave is encashable, and any notice recovery. Working days skip Saturdays and Sundays but not public holidays. Whether leave encashment counts as “wages” for the two-day rule is not yet settled. The fixed-term gratuity rule is shown as widely reported; check your contract. Not legal advice.

How many days does a company get to pay the full and final settlement?
Under Section 17(2) of the Code on Wages, 2019, in force from 21 November 2025, the wages of an employee who has resigned, been removed or retrenched are payable within two working days. Gratuity has a separate 30-day timeline. Enter your last working day in the checker to see your exact dates.
What is included in a full and final settlement?
Salary for the days worked in the final month, encashment of unused leave as per company policy, any bonus or incentive already due, and gratuity if you qualify. From that, the company can recover a notice-period shortfall, advances and assets not returned. PF is separate and is withdrawn or transferred through EPFO.
Is leave encashment taxable?
For non-government employees, leave encashment received on leaving is exempt up to ₹25 lakh in a lifetime (and within 10 months' average salary and 30 days of leave per completed year of service). Government employees' leave encashment is fully exempt. The rest is taxed as salary.
Do I get gratuity if I leave before five years?
Permanent employees need five years of continuous service; a part year of more than six months counts as a full year. Under the Code on Social Security, 2020, fixed-term employees get pro-rata gratuity after one year of continuous service.
My F&F is late. What can I do?
Email HR and payroll with your dates and amount and keep a copy (the checker drafts it). If it stays unpaid, you can file a claim with your state labour department under Section 45 of the Code on Wages within three years; the authority can award the amount plus compensation of up to ten times.
